What Do I Need to Start the Probate Process?

Probate can be complex and the courts require in-depth information about everything that might be relevant to the decedent’s estate. To start the process, you will need:

  • A certified copy of decedent’s death certificate.

  • Name, relationship to decedent, address, date of birth and social security number for all beneficiaries and interested parties, including decedent.

  • Original version of decedent’s Last Will and Testament, if applicable.

  • Copy of any trust or other document that may be relevant.

  • Information about all assets, including:

    • Vehicle/Boat/ATV – year, make, model, condition, mileage, VIN number, location of vehicle

    • House/Real Estate – address, information on value, purchase price, condition, mortgage, current status and Deed of Trust for any real estate owned by decedent.

    • Bank/Investment/Retirement/Stocks/Bonds – Most recent statement.

    • A list of any other valuables owned by decedent, including, but not limited to, jewelry, artwork, firearms, etc.

  • List and proof of any debts.
